Using Funguo means agreeing to these terms. They are written to be read, not to be survived.

1. What Funguo is

Funguo is a noticeboard. Owners and agents publish homes to let or to buy; people looking for a home search them and contact the person listed. That is the whole service.

2. Your account

Your phone number is your account. Keep the SIM and the phone secure; anything done with a code sent to that number is treated as done by you. You must be 18 or over, and the details you give must be true.

We may suspend or delete an account that publishes false listings, harasses other users, tries to harvest contact details in bulk, or breaks Kenyan law. Where we can, we will tell you why.

3. If you are listing a home

• You must have the right to let or sell the property, or written authority from someone who does.
• The price, size, features and photographs must be of that property and must be current. Photos must be yours to publish.
• Take a listing down, or mark it taken, once it is gone. A listing that is no longer available wastes every caller's time.
• Do not post the same property more than once, and do not post a property to collect enquiries you intend to redirect elsewhere.
• You are responsible for what you publish. You keep ownership of your photos and words, and you give us permission to display them on Funguo for as long as the listing is up.

4. Moderation, badges and labels

Every listing is reviewed by a person before it appears, and materially changing a live listing sends it back for review. We may reject or remove a listing, and we do not have to explain every decision — though we usually will.

Three labels mean three different things, and it matters that you do not confuse them:

• ID checked means a moderator looked at a photo of a national ID or passport and thought it was genuine. It says something about the person. It says nothing about whether they own the property, and it is not a guarantee against fraud.
• Agent means the account holder is paying for an agent plan. It is a disclosure, not an endorsement.
• Featured means someone paid to raise a listing's position for a fixed period. It is advertising, and it is always labelled as such.

5. Contact details

An owner's phone number is not published in bulk. When you ask for one, we record that you asked. Using Funguo to collect contact details for marketing, for a competing list, or for any purpose other than enquiring about that specific home is a breach of these terms and may breach the Data Protection Act, 2019.

6. Paying for a plan or a boost

• Owners publish free, up to FREE LISTING LIMIT, currently 5 listings.
• Agent plans are paid by M-Pesa and run 30 days from the moment payment clears. Nothing renews automatically — an M-Pesa STK push is a one-time prompt, not a stored card, so a lapsed plan simply stops raising your listing limit.
• Boosts run for the period bought, 7 or 30 days.
• Refunds: STATE THE REFUND POSITION PLAINLY — e.g. no refunds once a plan is active, except where the service was unavailable.
• Prices may change. A change never affects a period you have already paid for.

7. What we do not promise

We try to keep Funguo accurate and available, but we cannot promise that a listing is true, that a person is who they say they are, that a property exists, or that the site never goes down. The cost calculator produces estimates using published rates and typical bank terms; rates, county charges and bank terms change, and the figures are not financial advice.

Check any property in person. Confirm ownership and title through an advocate before paying anything. That advice is not a formality — it is the single most important line on this page.

8. Liability

LIABILITY LIMITATION CLAUSE — to be drafted by an advocate. In outline: we are responsible for running the platform honestly and carefully; we are not responsible for the conduct of users, for the condition of a property, or for a dispute between a landlord and a tenant, or a buyer and a seller. Nothing here limits liability that cannot lawfully be limited.

9. Complaints and disputes

Tell us first: support@yourdomain. Most things are a misunderstanding and are fixed the same week. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

10. Changes

We may change these terms. The date at the top changes with them, and we will tell you about any change that materially affects you. Continuing to use Funguo after that means accepting the change.
